These Terms of Use ("Terms") govern your use of the Polo mobile application (collectively, the "Platform") made available by Primetrace Technologies Private Limited ("Polo", "Company", "we", "us" and "our"), a private company established under the laws of India having its registered office at  32/5, 3rd Floor, Above DHL, Ganapa Towers, Begur, Hobli, Hosur Rd, Roopena Agrahara, Bommanahalli, Bengaluru, Karnataka 560068. The terms "you" and "your" refer to the user of the Platform. These Terms are to be read with the Polo Privacy Policy. If you do not agree with these Terms, please do not use this Platform. Our Services (as described below) and these Terms are in accordance with the Information Technology Act, 2000, and other applicable laws including all amendments thereto and rules framed thereunder. When you create an account on our Platform or use our Platform or any of our Services, you accept and agree to these Terms. However, we do not represent that the Platform complies with the laws of any jurisdiction other than the Republic of India. If you wish to use our Services, please ensure that you are permitted to do so, in your jurisdiction. Please read these Terms and all other hyperlinks mentioned here carefully. By accessing, using the services of the application you are bound by the terms and conditions of this agreement. Also, if you are using these services outside India, you are responsible for complying with your local laws. CHANGES TO TERMS AND SERVICES Our Platform is dynamic and may change rapidly. As such, we may change the services we provide at our discretion. We may temporarily or permanently stop providing Services or any features to you generally. We may remove or add functionalities to our Platform and Services without any notice. However, if we make a change where your consent is required, we will make sure to ask for it. Please be sure to keep visiting this page from time to time to stay updated on our latest changes, developments and services that we may add or modify from time to time. WHO MAY USE OUR SERVICES Our Platform helps you stay in touch with your community or your organisation and enables you to connect with other people on the platform. We understand your preferences and personalize your feed to show you people on our platform ("Service/Services"). Eligibility

 You must be at least 18 years old. By using the Services on the Platform, you represent and warrant that you are at least 18 years of age.  You are legally capable of entering into a binding agreement under applicable Indian laws.  You are legally permitted to use our Services under the laws of India and the laws applicable in your country of residence.

 You will use the Services only for lawful purposes and in accordance with these Terms.

We may ask for date of birth/identity verification (including government ID). If you do not provide it when requested, we may restrict or terminate your account. Verification features are intended to enhance user authenticity, improve platform safety, and promote trust among users. Users who successfully complete the verification process may receive a visible verification on their profile. The Verification only indicates that certain identity checks have been completed and does not guarantee the accuracy of user information or the conduct of any user on the Platform.

HOW TO USE OUR SERVICES We have developed a unique platform. Our Services are available exclusively in Hindi and English languages. We strive to give you belongingness to your community via digital medium. We also allow you to download content that is available on our Platform and share your Polo experience across social media platforms or use our Services, you must register on our Platform by completing the account creation process, which include providing your mobile phone number, verifying your number through a One-Time Password (OTP) sent via SMS, confirming that you are at least 18 years of age. The user shall provide only information that is authentic and lawfully yours to use, and you shall not impersonate any person, use another person’s contact details, or upload content that you do not own or are not authorised to use. You agree to provide accurate and complete information during the registration. We do not read any information stored on your mobile device and computer without your permission. PURPOSE OF THE PLATFORM Polo provides a digital space for adults to discover and communicate with other adults.We do not Guarantee matches, compatibility, or relationship outcomes. You are solely responsible for your interactions, including offline meetings. GENERAL NOTES ON CANCELLATION AND REFUND

1. The user may access the application by subscribing to the Trial Pack at INR 1 for one (1) day. By subscribing to the Trial Pack, the user is automatically enrolled in the Premium Monthly Plan (30 days) and agrees that the full premium subscription fee will be charged automatically unless the subscription is cancelled before the trial period expires.
2. UPI Autopay: Our subscription transactions in India use UPI autopay to setup and manage your subscription payments.

o UPI auto-pay method allows your subscription to renew automatically before it expires, ensuring uninterrupted continuation of your service. The renewal happens up to 96 hours prior to the plan expiry date - this is done to ensure, that you enjoy continued and uninterrupted subscription benefits. o If your subscription payment fails for any reason, we may continue to retry to charge the payment to your account for up to 20 days after the subscription expiry date, after which your subscription will be marked cancelled in our system. o You have the flexibility to unsubscribe your active subscription at any time from your account settings, your subscription will automatically cancel after the paid for subscription period ends. o Any payments made prior to cancellation are non-refundable. 3. You will continue to receive the premium benefits till the end of the plan for which you have been charged prior to the cancellation event. 4. You can raise the refund request by writing to us at [email protected], with your reason. Polo reserves the right to not provide refund in case we think the reason is not valid 5. In case there is more than one interpretation of any of the terms mentioned above, the company reserves the right to make the final and binding interpretation. 6. In all cases, you agree that any disputes will be subject to the laws applicable in India, and the courts of Bangalore shall have exclusive jurisdiction over all such disputes.

PRIVACY POLICY To effectively provide and introduce any new Services to you, we collect certain information such as your phone number and date of birth. We may further request and store additional information. Such information is stored securely on amazon web services or "AWS" cloud servers and the "Google Cloud Platform" cloud servers, thereby also subject to the terms of the AWS and Google Cloud privacy policy. The Polo Privacy Policy explains how we collect, use, share and store the information collected. The Polo Privacy Policy also details your rights under law and how you may control the data you provide us. You provide us with some information about yourself so that we can serve you better. We have described how we store and use this information in the Polo Privacy Policy.

PURPOSE OF THE PLATFORM Polo provides a digital space for adults to discover and communicate with other adults. We do not Guarantee matches, compatibility, or relationship outcomes. You are solely responsible for your interactions, including offline meetings.

Guidelines You agree to use the Platform responsibly and in compliance with applicable laws. Our Platform is intended to support a diverse community of users, and you must not engage in any activity that harms other users, the Platform, or the public. You must not:

• Harass, threaten, stalk, abuse, or repeatedly contact any user who has asked you to stop, or use hate speech, abusive language, or discriminatory content based on caste, religion, gender, sexual orientation, or any protected category.
• Impersonate another person, create fake profiles, provide false or misleading information, or use the Platform in a deceptive manner.
• Share, request, or threaten to share private, confidential, or intimate information without consent, or engage in blackmail, extortion, fraud, phishing, or other deceptive activities.
• Share or upload any content that is obscene, pornographic, harmful to minors, unlawful, discriminatory, violent, hateful, seditious, or otherwise prohibited under the laws of the Republic of India.
• Share or request non-consensual sexual content, or any content involving minors, or use the Platform for prostitution, escort services, trafficking, or other illegal activities.
• Use the Platform for spam, advertising, solicitation, or any commercial purpose without our permission.
• Record conversations, take screenshots, or distribute content for the purpose of harassment, exposure, or misuse without consent.
• Attempt to interfere with the security, integrity, or proper functioning of the Platform, including unauthorized access, use of bots, scraping, or introducing malicious software.
• Allow others to use your account, create multiple accounts without permission, or fail to maintain the security of your device, phone number, or login credentials. We reserve the right to monitor activity, remove content, restrict features, suspend, or terminate accounts that violate these rules or create risk to users or the Platform. We may also share information with law enforcement authorities where required by law, or where necessary to protect the safety of users, the public, or the Platform.

You understand that the Platform only provides a space for users to connect, and we are not responsible for the actions of other users, including any interactions that occur outside the Platform. Users should exercise caution while sharing personal information or meeting others.

DEVICE SECURITY You are responsible for maintaining the security and confidentiality of your device and account credentials. You must ensure that your device is protected with appropriate security measures and is not accessed by unauthorized persons. You must not share your account,

allow another person to use your registered phone number, or create multiple accounts without our permission. All activities carried out through your account shall be deemed to be your responsibility.

REPORTING, MODERATION, AND ENFORCEMENT We may use automated tools and user reports to detect misuse, to maintain safety, prevent fraud, and enforce these Terms. We may remove content, restrict accounts, or terminate users if we believe that the Platform is being misused. Users may report profiles or messages through the Platform or by contacting support. If any of our users report your content to be against the Polo Terms of Use, we may remove such content from our Platform. If multiple reports are made regarding violation of the Polo Terms of Use, we may be compelled to terminate your account with us and block you from registering with us alongwith removal of content from platform. USER CONTENT, LICENSE, AND LIABILITY You retain ownership of the content you upload, post, or share on the Platform, including photos, text, messages, and other materials, subject to the license granted below. When you share content through our Services, you give Polo permission to use, store, and process that content only as needed to provide, improve, and protect the Services.This license will continue until the content is deleted by you or your account is terminated, except where retention is required by law or for legitimate safety, legal, or operational purposes. You may request deletion of your content or account at any time, subject to applicable legal and safety requirements. All intellectual property rights in the Platform, including content developed by us, remain the property of the Company or its licensors, and such content may not be copied, reused, or distributed without permission. You must not upload or share content that infringes the intellectual property rights, privacy rights, or any other rights of any person. We may remove any content that violates these Terms or applicable law. We do not endorse, control, or take responsibility for content shared by users on the Platform. The presence of our name, logo, or trademarks on the Platform does not mean that we approve or sponsor any user content. The Platform may include services or features provided by third parties, and we are not responsible for the actions, content, or services of such third parties.

To the maximum extent permitted by law, we shall not be liable for any loss of profits, data, revenue, or any indirect, incidental, special, or consequential damages arising from the use of the Platform, including removal of content, suspension of accounts, or actions of other users. Polo operates as an intermediary under applicable Indian laws and does not control user- generated content. However, we reserve the right to remove content or restrict access where required to comply with law, enforce these Terms, or protect users or the Platform

NO MINOR CONTENT This app is only for people who are 18 or older. Any upload, sharing, solicitation, storage, transmission, or use of images, videos, messages, profiles, or other content involving a person under 18 in a sexual, obscene, exploitative, abusive, or inappropriate manner, including morphed, fabricated, or digitally generated depictions, is strictly prohibited and may lead to immediate account termination and reporting to competent authorities.

PLATFORM SECURITY AND MISUSE You must not interfere with the proper functioning, security, or integrity of the Platform. You agree not to access non-public areas of the Platform, attempt to bypass security measures, introduce viruses or malicious software, use bots, scrape data, or test the vulnerability of any system without authorization. Any attempt to hack, disrupt, tamper with, or misuse the Platform may result in suspension or termination of your account, and we may take legal action or report such activity to law enforcement authorities where required

THIRD-PARTY SERVICES If Polo integrates third parties (payments, analytics, verification), their terms may apply. Users are advised to separately review the applicable terms, privacy policy, and other policies of such third parties before using or relying on their services. Polo is not responsible for third-party services.
